Statutory Medical Software Disclaimer:

PharmaPulse ERP is strictly an inventory management, GST billing, and enterprise resource planning software tool. PharmaPulse India does NOT prescribe, manufacture, compound, or sell pharmaceutical drugs. The registered pharmacist / store licensee bears sole and absolute statutory responsibility for medicine dispensation and doctor prescription compliance under the Drugs and Cosmetics Act, 1940 and Pharmacy Practice Regulations.

1. Acceptance of Terms

By creating an account, taking a Free Trial, downloading, or using PharmaPulse ERP (the "Service"), you ("Subscriber", "Pharmacist", or "Chemist") agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service.

2. Permitted Commercial Use & License

PharmaPulse India grants you a non-exclusive, non-transferable, revocable commercial license to use the ERP software for managing your retail/wholesale medical store in accordance with your subscribed plan tier (Lite, Smart, Prime, or Enterprise).

You may not reverse-engineer, decompile, modify, or tamper with the software license keys.
One license is valid for the registered business entity and designated branch counters only.
Sharing license keys or bypassing hardware device verification is strictly prohibited and subject to immediate termination.

3. Pharmacist & Regulatory Responsibilities

The Subscriber explicitly agrees and warrants that:

They hold a valid, active Retail/Wholesale Drug License issued by the State Drugs Control Authority.
Schedule H, H1, and X medicines are dispensed strictly against authentic Registered Medical Practitioner (RMP) prescriptions.
Batch numbers, expiry dates, and MRP entries into the ERP remain the sole responsibility of the pharmacy billing staff.

4. Limitation of Liability

Under no circumstances shall PharmaPulse India, its founders, or affiliates be liable for any direct, indirect, incidental, or consequential damages resulting from dispensing errors, tax miscalculations due to manual HSN entry, hardware failures, or regulatory inspections by Drug Control Authorities.

5. Service Availability & Uptime

PharmaPulse ERP incorporates dual Offline & Cloud synchronization. While we target 99.9% cloud server uptime, local desktop billing continues uninterrupted offline during internet outages.
